The NJ E-Bike Law: Day 5 – What About E-Scooters?

As questions continue to come in about New Jersey’s new e-bike law, one topic keeps popping up: e-scooters. In this Day 5 update, I want to clarify where scooters currently stand under the law and what riders should know right now.
Are E-Scooters Included in the New Law?
The short answer, as of today, is no.
E-scooters with a deck or floorboard, handlebars, and an electric motor are not currently included in the newly passed NJ e-bike legislation. At this time, they remain regulated under the existing electric bicycle classification rules.
What That Means for Scooter Riders
Right now, scooters that meet the state’s definition are treated similarly to bicycles, which means:
- No driver’s license required
- No registration required
- No insurance required
However, helmets are mandatory. While this rule is often overlooked in practice, it is still the law.
Where You Can (and Can’t) Ride
E-scooters are generally permitted in:
- Bike lanes
- Roadways and streets
- Bicycle paths
They are not permitted on sidewalks. Parking on sidewalks is currently allowed, but riding on them is not.
It’s also important to note that these rules are subject to local regulations. Riders should always check their municipal ordinances, as some towns may have additional restrictions.
Why This Matters
As we’ve seen with e-bikes, regulations can change quickly. While scooters are not part of the new law today, that doesn’t guarantee they won’t be addressed in future legislation.
For now, scooters remain legal under existing rules, but staying informed is key.
