The NJ E-Bike Law: Day 29 – The 90-Day Regulatory Freeze and What It Means

It is very common when a new governor and administration take office to issue a temporary freeze on new regulations. This allows the administration time to review what is in the pipeline and understand how laws will be implemented before final rules are written.

On January 23, 2026, Governor Sherrill signed an executive order placing a 90-day freeze on new regulations.

So how does that affect the New Jersey e-bike law?

The Law Is Passed — But Implementation Is Paused

The law itself cannot be undone by this freeze. That is important to understand.

However, the real impact of the law depends heavily on how it is implemented. Registration systems, insurance procedures, enforcement guidance, exemptions — those details are defined in regulations, not directly in the statute.

And those regulations are currently paused.

This has created confusion, because a law was passed without finalized systems to implement it. But it also creates opportunity.

Why This Delay Could Work in Our Favor

Because regulations are frozen, agencies cannot finalize forms, systems, or enforcement policies that would lock the law into rigid operation.

Once regulations are finalized, changing course becomes slow and politically costly. Right now, the framework is still flexible.

The freeze also gives the new administration time to reassess whether the law aligns with:

  • Transportation policy goals
  • Disability access protections
  • Climate initiatives
  • Small business stability

This administration did not design the law. The pause gives them room to evaluate it before it becomes fully operational.

This Is the Moment for Advocacy

During a regulatory freeze, agencies are actively collecting feedback. This is when outside pressure has the most impact.

This is when advocates, small businesses, and disabled riders have the most leverage.

If you are affected by this law:

  • Find your state and local legislators and write to them
  • Contact the Governor’s office regularly
  • If you are a bike shop, participate in industry surveys and advocacy efforts
  • If you are disabled and impacted, share your story

Data matters. Personal stories matter. Consistent pressure matters.

We do not have unlimited time. Nearly a month has already passed in this 90-day window.

If change is going to happen, this is when it must happen.
